Obviously this is unconstitutional, given that <em>Roe v Wade<\/em> is standing case law. Congress can\u2019t ban getting treated for skin cancer; they can\u2019t ban getting treated for a heart condition; they can&#8217;t ban prenatal care. Abortion is a medical right in 50 states, so how exactly does that get taken out? The way our government works, the Supreme Court would need to sort that out, when the provision is challenged in a lawsuit.<br \/>\n<\/span><\/span><\/p>\n<p>But now we have another question: WHY exactly would they take it out of the health care law? And how can this happen without a debate, and without women speaking up, as if it\u2019s just the normal thing you do nowadays? This question is more complex than is allowed into public discourse. When I explain to both men and women that banning abortion, or the attempt to do so, is to preserve a \u201ctraditional\u201d role for women, that often comes as real news. This agenda needs to be explained.
